Terms and Conditions

NOW, THEREFORE, in consideration of the mutual premises and covenants contained herein, the Parties agree as follows:

Terms of Services
✴ Simply Gone Mobile Dumpsters is being hired to provide dumpster(s) and haul away service at the address contained in the estimate/invoice.
✴ Simply Gone Mobile Dumpsters will provide a 10-yard mobile dumpster for up to 7 calendar days (or) a 15-yard mobile dumpster for up to 7 calendar days (or) a 30-yard size (two 15-yard mobile dumpsters) for a period of up to 7 calendar days.
✴ Additional tonnage will be billed at $165 per ton. See attached 2025 Fees and Material Restrictions for the cost of additional waste disposal. or click on the following link: https://www.simplygonemobiledumpsters.com/additional-fees/
All fees shall be subject to New York State sales tax as required.
✴ Simply Gone Mobile Dumpsters will not accept household hazardous waste under any circumstance. Should household hazardous waste be placed into the dumpster, fees will be assessed accordingly at a rate To Be Determined. *See attached 2025 Fees and Material Restrictions for list of prohibited items or click on the following link:

✴ Mobile Dumpster Rentals: By Approving this estimate, the Addressed Party named on the Estimate/Invoice acknowledges that they have the legal right and authority to direct any and all property placed into the mobile dumpster be removed by Simply Gone Mobile Dumpsters LLC under the terms of the contract herein.
✴ Full Service: By Approving this estimate, the Addressed Party named on the Estimate/Invoice acknowledges that they have the legal right and authority to direct any and all property and/or contents within the residence and about the property located at the address named on the Estimate/Invoice to be removed by Simply Gone Mobile Dumpsters, LLC under the terms of the contract herein.
✴ Access: Ensure sufficient space for both delivery and pickup. You are responsible for any damage resulting from inadequate access. If the designated location (e.g., driveway) is blocked, preventing delivery or pickup, a $100 service fee will apply, and the rental will be forfeited without refund.
✴ If a dispute arises regarding the ownership of said property and/or contents, I hereby will forever hold harmless Simply Gone Mobile Dumpsters, LLC, their associates and assigns. I agree to indemnify Simply Gone Mobile Dumpsters, LLC from any future litigation or damages relating to the removal of said property and/or contents removed under terms of this contract and addendums.

Duties and Responsibilities of Simply Gone Mobile Dumpsters:
The duties of Simply Gone Mobile Dumpsters shall be as follows:
1. The client shall have services provided as contracted. If there is a question regarding prohibited items, they will be addressed promptly and without delay.
2. Simply Gone Mobile Dumpsters shall provide dumpsters in good working order, with locks and other necessary equipment to provide for safe and easy use.
3. Simply Gone Mobile Dumpster shall promptly deliver and pick up dumpsters at the customer location as promised and scheduled. The dumpster shall be the agreed size above and if said size is not available an equal or better replacement shall be provided at no additional fee.

Client Responsibilities:
1. The client shall be responsible for the items placed in the dumpster and any amounts over the agreed upon weight.
2. Payment for services shall be made in advance. If payment is not received no less than 24 hours prior to delivery of dumpster, the service shall be terminated and the deposit forfeited.
3. A credit card or source of payment must be provided at the time of reservation. Client agrees that any tonnage overage, additional disposal items or prohibited items will be charged upon dumping with notice and final receipt provided to the customer.
4. Client will ensure the dumpster is locked and secure for the duration of use. The client will be solely responsible for any damage and/or theft that occurs to the dumpster while in their possession and use.
5. Client shall not overload the dumpster. Each unit is clearly marked with a maximum fill line. Filling above the maximum causes damage to the unit. any damage sustained due to overloading is the direct responsibility of the client and will be charged accordingly.

Termination:
1. If the contract is terminated by Simply Gone Mobile Dumpsters, the fees already paid under the contract shall be refunded if no other comparable dumpster or delivery date is available.
2. If the contract is terminated by the client, there shall be no refund of the deposit made. The same shall be credited to any future rental of an equal or larger sized unit.

Indemnification. If the Client engages in bad faith and has a civil or criminal charge that is brought upon him or her as a result of or in connection with their rental or disposal of property, they will indemnify the Company against any and all liability present and future in connection with their wrong doing.
Governing Law. This Agreement shall be construed by and controlled under the laws of the State of New York, without regard to its conflict of law principles and without regard to the place of execution.
Attorneys’ Fees. In the event either Party files or institutes any lawsuit arising out of, or related to, this Agreement, the substantially prevailing Party shall recover from the other Party its reasonable attorneys’ fees and expenses relating to the litigation.
Force Majeure. In the event of strikes, material labor unrest, acts of war, fire, explosion, riot, looting, terrorism, civil commotion, failure of machinery or plant, earthquake, or acts of governmental authorities, or other causes beyond the control of a Party, which shall render it impossible for such Party to comply with the terms of this Agreement (each a “Force Majeure Event”), no liability for such Party for non-compliance caused thereby during the continuance thereof shall exist or arise; provided, however, that client continues with their rental after the situation has passed.
Survival. The indemnification obligations set forth in this Agreement shall survive the expiration or termination of this Agreement for the duration of the applicable statute of limitations.
Entire Agreement. This Agreement contains the entire agreement and understanding between the Parties relating to the subject matter contained herein. There are no other representations, warranties, covenants, understandings or agreements between the Parties not contained in this Agreement.
Amendment. This Agreement may be amended or altered at any time, in whole or in part, by a written instrument signed by both Parties. This includes any extension of the rental term.

IN WITNESS WHEREOF, the Parties have executed this Agreement the date and year of the Estimates approval, and acknowledge it shall become effective as of the Approval Date.
