Customer Terms and Conditions

1. General Terms
By scheduling a service or purchasing a product from Rest Assured HVAC (“Company”), you (“Customer” or “Client”) agree to these legally binding terms and conditions. Please review them carefully.

2. Services Provided
The Company offers the following services:
• HVAC Installation, Maintenance, and Repair
• Preventive Maintenance Plans
• System Inspections and Diagnostics
• Warranty Service and Support
All services will be detailed in the service agreement, quote, or invoice.

3. Estimates, Payments & Billing
Estimates
• Estimates are valid for 15 calendar days from the issue date.
Payment Terms
• Payment is due at the time of service unless agreed otherwise in writing.
• Accepted payment methods:
o Cash, check, online payment, and bank transfer (for approved customers).
o Credit cards (subject to a convenience fee).
• A deposit of up to 50% may be required for certain jobs; the remaining balance is due upon completion.
• Special order and non-stocked item purchases are final and non-refundable, except for manufacturer defects or unavailability.
• Deposits for scheduled services are non-refundable unless canceled in writing at least 48 hours before the appointment.
Late Payments & Fees
• Late payment fee: $25.00 per invoice.
• Unpaid balances: Subject to 1.67% monthly compounding interest.
• Returned payments: $35.00 fee per invoice, plus 1.67% monthly interest (retroactive to the invoice date).
• Continued failure to pay within 30 days may result in collections, additional fees, and third-party or court collection costs. Clients will receive written notice before escalation.
Refunds
• Refunds may be issued for overpayments or if agreed-upon services were not provided.
• Refund requests must be submitted in writing within 15 calendar days of service via a trackable delivery service.
• Approved refunds will be processed within 15 business days.

4. Preventive Maintenance
Regular HVAC maintenance is essential for efficiency and longevity. Our services include:
• Checking and replacing air filters
• Inspecting electrical connections
• Cleaning condenser and evaporator coils
• Testing system performance
⚠️ Failure to perform regular maintenance may void manufacturer warranties.

5. Warranty Coverage
Manufacturer Warranty
• Products may include a limited warranty covering:
o Parts: Select components covered for a specified duration.
o Labor: May be available for certain installations or as an additional purchase.
• Customers must register their product within the required timeframe to activate the warranty.
• Warranty claims require proof of purchase.
• Warranties become void if the equipment is:
o Tampered with
o Improperly maintained
o Not maintained per manufacturer guidelines
🔹 A diagnostic service fee may apply if the issue is unrelated to our workmanship or covered warranty. Clients will be informed of any fees before repairs proceed.
• Repairs performed under the manufacturer warranty do not extend the original warranty period.
Workmanship Warranty
• The Company provides a 1-year service warranty on labor.
• If an issue arises due to our workmanship within this period, we will address it at no additional charge.
• Repairs performed under this workmanship warranty do not extend the original warranty period.

6. Exclusions and Limitations
Warranty and service coverage do not apply to:
• Damage from improper installation by third parties
• Lack of regular maintenance
• Unauthorized repairs or modifications
• Acts of nature (e.g., storms, floods, lightning, earthquakes, power surges, pest-related damage)
• Normal wear and tear beyond warranty coverage

7. Cancellation and Rescheduling
• Clients must notify us at least 48 hours in advance via phone to cancel or reschedule.
• Cancellations within 48 hours may incur a $250.00 non-refundable cancellation fee.
• Reschedules within 48 hours may incur a $125.00 non-refundable rescheduling fee.
• Exemptions from cancellation fees (at the Company’s discretion) may apply for:
o Verified medical emergencies
o Severe weather
o Power outages
• Missed appointments without notice may incur a $250.00 no-show fee.
• If the Client is unavailable within 30 minutes of the scheduled time, the appointment may be marked as missed and subject to a non-refundable no-show fee.

8. Liability Disclaimer
• The Company carries general liability insurance but is not responsible for pre-existing conditions or damages caused by external factors.
• The Company is not liable for indirect, incidental, or consequential damages, including:
o Improper use or maintenance
o Delays beyond our control (e.g., weather, manufacturer delays, unforeseen failures, pre-existing conditions)
• Liability is limited to the cost of the service provided and paid for by the Client, excluding material costs.
• Energy efficiency improvements are not guaranteed unless explicitly stated in writing.
• Failure to follow manufacturer-recommended maintenance and Company service recommendations may void applicable warranties.

9. Customer Responsibilities
Clients must:
• Provide accurate information about the HVAC system and service needs.
• Ensure the service area is accessible and free of environmental, health, inhalation, or physical hazards.
• Follow manufacturer-recommended maintenance schedules.
• Report issues promptly to prevent further damage.
• Obtain necessary permits (if applicable) and arrange for inspections unless otherwise agreed.

10. Changes to Terms
• The Company reserves the right to update these terms at any time.
• Clients will be notified of significant changes before their next scheduled service.

11. Confidentiality and Privacy
• The Company respects client privacy and handles all personal and service-related data confidentially, in compliance with applicable laws.

12. Dispute Resolution
• Clients agree to mediation before pursuing legal action.

13. Governing Law
• These terms are governed by the laws of Illinois.
• Disputes will be resolved through arbitration or in the courts of Kane County, Illinois.
