Mayday Cleaning Services: Terms and Conditions

Welcome to Mayday Cleaning Services. By utilizing our services, you agree to these terms, which apply to all interactions, including invoices, website usage, and client engagements in Los Angeles County, California, and surrounding areas.

Definitions

- "Service" refers to any cleaning service provided by Mayday Cleaning Services as described on our website or in our promotional materials.
- "Client" refers to any individual or entity engaging Mayday Cleaning Services for cleaning services.
- "Excessive interruptions" include, but are not limited to, frequent requests for assistance unrelated to the cleaning service, moving furniture or belongings without prior arrangement, or requiring our team to stop work for extended periods.

Introduction

- Your use of our services and website is governed by these terms and conditions. By engaging with us, you consent to comply and be bound by these terms. If you disagree, please refrain from using our services and website.
- We reserve the right to modify these terms at any time. We will notify you of any significant changes via email or a prominent notice on our website. Continued use of our services after any modifications constitutes acceptance of the updated terms.

Service Descriptions

- We offer a wide range of cleaning services as detailed on our website's "Service Descriptions" page and in our promotional brochures. Limitations or exclusions to these services are clearly communicated and easily accessible for client review within these materials.

Quote Accuracy

- Estimates are based on the client's description of their home's condition. If we find the condition is significantly different from your description, we will call and request a price adjustment.
- A "significantly different" condition is one where the level of cleaning required exceeds the initial estimate by more than 20%.
- If we cannot reach you, and you have not pre-approved the additional charge in writing via email or text message, we will only stay for the duration covered by the initial quoted price. Please note that the quality of the work may be compromised in such cases, and we will not be held liable for any resulting dissatisfaction.

Condition

- We will do our best to work around any activity in your home during the cleaning. However, excessive interruptions may prevent us from completing all tasks within the estimated time.
- You may purchase additional time, or we may adjust the tasks completed based on the available time. Our team may take photos to document the initial condition of the home and any challenges encountered.
- It is your responsibility to ensure a safe and workable environment for our cleaners.

Access

- Our service time starts upon arrival and includes loading/unloading supplies. If we have to wait for access, cleaning time will be reduced accordingly.
- If access is delayed for more than 15 minutes, a late fee of $25 or a cancellation fee may apply, at our discretion.

Collections

- Payment in full is due at the time of service. NSF checks, non-payment, or declined credit cards may result in additional fees of up to $50 associated with collections.
- If your account is referred to a collection agency, you will be responsible for any fees charged by the agency in addition to the outstanding balance and late fees.
- Your credit card number is securely retained in our password-protected scheduling system. We may charge this card if your account becomes delinquent for non-disputed services after a 14-day grace period.

Home Entry

- Access Requirement: Provide access for scheduled cleanings. A 50% service charge applies for denied access.
- Client Presence: Optional, but please be reachable between 9:00 a.m. and 5:00 p.m. on service days.
- Key/Code Access: Managed securely with confidentiality.
- Lockbox Option: Available; please share the passcode securely.
- We recommend using a lockbox or smart lock for added security and convenience.
- Home Alarms: Inform us of any code changes. We are not liable for false alarm charges due to uncommunicated changes or incorrect codes provided.
- Liability Note: Mayday Home Cleaning Services is not liable for damages or losses resulting from unauthorized access due to unsecured entry methods chosen by the client.

A/C Required

- Due to the warm temperatures we experience in Southern California, particularly during the summer months, we kindly request that you have the air conditioning on and set to a comfortable temperature for our cleaners while they are working in your home.

Damage Reporting

- Report any damages within 24 hours of service completion, preferably in writing. Photos are encouraged but not required. Our liability is limited to a maximum of $500 or the cost of the service provided, whichever is less. Damages reported after 48 hours will not be considered.
- We may bypass excessively cluttered areas for safety reasons.

Pets

- Please secure, confine, or remove all pets from the premises before our team arrives. We are not responsible for pets that escape during our service.
- If unsecured pets interfere with cleaning or cause damage, we may charge an additional fee of up to $50 or terminate the service.

Specifications

- Please review your estimate/invoice and our website for detailed service specifications to ensure you understand the areas included in your cleaning. If you have any special requests or modifications, please contact us at least 24 hours before your scheduled cleaning, as additional charges may apply. We have a two-hour arrival window.

Pricing and Payment Terms

- Deposit: A non-refundable 50% deposit is required to book your appointment. You may reschedule once to avoid losing the deposit.
- Final Payment: The remaining balance is due immediately at the time of service.
- Late Payment: A 10% per month interest late fee applies to unpaid balances after a 7-day grace period.
- Collections: Unsettled accounts after 3 months may be referred to a collection agency. You will be responsible for any fees charged by the agency in addition to the outstanding balance and late fees.
- Payment Methods: We accept checks, major credit cards, and Zelle.
- Returned Checks: Subject to an additional $25.00 fee.

Payment Authorization

- By agreeing to our services and making a payment, you authorize us to charge the provided payment method for the agreed-upon amount, including any additional services requested.
- For recurring services, you authorize recurring charges until cancellation.
- Credit Card Authorization: If you choose to pay by credit card, you authorize Mayday Cleaning Services to access funds from the provided card for the agreed-upon amount.

Dispute Resolution

- In the unlikely event that you are dissatisfied with the service provided, please contact our customer support team within 24 hours of the service date. We are dedicated to resolving any issues and will work with you to address your concerns promptly and fairly.
- Refunds or service re-performances may be offered at the discretion of Mayday Home Cleaning Services for valid concerns, such as incomplete tasks or accidental damage, with our liability limited to the original cost of the service.

Chargeback Disputes

- Should a chargeback be initiated without prior communication with our customer support team, Mayday Home Cleaning Services reserves the right to dispute the chargeback. We will provide all necessary documentation, including proof of service, signed agreements, and communication records, to the payment processor or financial institution to demonstrate that the services were provided as agreed.
- You agree to cooperate with us in resolving any chargeback disputes and will reimburse us for any fees or costs incurred in disputing a chargeback.

Fraudulent Chargebacks

- Any chargeback found to be fraudulent or issued in bad faith will result in immediate termination of services and may lead to legal action. You will be responsible for any legal fees or associated costs incurred by Mayday Home Cleaning Services in the process of disputing such a chargeback.

Final Sale

- Payments for services rendered by Mayday Home Cleaning Services are considered final. No refunds will be issued once the service has been completed, except under the specific circumstances outlined in our dispute resolution process.
- You have the right to cancel recurring services at any time, but no refunds will be issued for services already rendered.

Special Requests

- We are happy to accommodate special requests with at least 24 hours' notice. Additional charges may apply for last-minute requests.

Cancellation and Refund Policies

- Within 24-hour Notice: $75 cancellation fee.
- Same-day Cancellation: Full service fee charged.
- Refunds: Provided at our discretion for unresolved service issues, as outlined in our dispute resolution process.

Liability and Insurance

- We maintain comprehensive insurance coverage for damages, limited to the cost of service provided.

Health and Safety Compliance

- We adhere to OSHA guidelines and local regulations for cleaning chemicals and equipment.

Employee Conduct

- Our employees follow strict guidelines and undergo comprehensive background checks.

Licenses and Permits

- We operate with all necessary local and state licenses and permits.

Service Limitations

- We are not responsible for pre-existing damages or inaccessible/unsafe areas.

Non-Solicitation

- A fee of $2,500 applies if you directly hire our employees during or within 6 months of their last service at your home.

Service Modifications

- We reserve the right to modify or cancel services due to unforeseen circumstances, with prior notice whenever possible.

Intellectual Property

- All content and branding on our website and marketing materials are proprietary. Unauthorized use is prohibited.

Force Majeure

- We are not liable for service delays or failures due to events beyond our control (e.g., natural disasters, power outages).

Governing Law

- These terms are governed by the laws of California, under Los Angeles County jurisdiction.

Changes to Terms

- Updates to these terms are effective upon posting on our website.

Working in the Home

- Safety First: Our cleaners prioritize their safety; you are responsible for ensuring a safe environment in your home.
- Right to Leave: Our cleaners may leave if they feel their safety is compromised. You will still be billed for the full scheduled service.

Our Guarantee

- Issue Reporting: If you have any concerns about the service, please call 1-866-244-0672 within 24 hours.
- Re-clean: We offer a complimentary re-clean for valid concerns, subject to limitations and our discretion.

Payment Verification and Fraud

- We reserve the right to verify the identity of any credit card holder and confirm the legitimacy of the payment source.
- Fraudulent use of payment methods is strictly prohibited and will be reported to legal authorities.

Non-Refundable Deposit for Large Bookings

- A non-refundable deposit may be required for large or high-cost services. This deposit will be applied to the total service cost but is non-refundable in case of cancellation.

Chargeback Clause

- In the event of a chargeback, you are responsible for the original transaction amount plus any additional fees incurred by us.

Proof of Service Delivery

- We provide detailed invoices and may offer proof of service (like before-and-after photos), which can be used in disputes or chargeback investigations.

Website Use and Content

- You may not copy, distribute, or modify any content from our website without prior written consent. We strive for accuracy but do not guarantee the completeness or timeliness of website information.

Intellectual Property

- All trademarks, logos, and service marks on our website are our property or the property of third parties. You may not use these without prior written consent.

MAYDAY CLEANING SERVICES DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

- Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAYDAY CLEANING SERVICES, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES OR WEBSITE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES OR WEBSITE; (iii) ANY CONTENT OBTAINED FROM THE SERVICES OR WEBSITE; OR (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT MAYDAY CLEANING SERVICES HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

Additional Terms

- Account Security: If you create an account, you are responsible for maintaining its confidentiality.
- Indemnification: You agree to indemnify and hold harmless Mayday Cleaning Services, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

- Any negligence or willful misconduct on your

- Complete Agreement: These terms constitute the entire agreement between you and Mayday Cleaning Services.
- No Waiver: Our failure to enforce any provision does not waive any provision or right.
- Severability: If any provision is invalid or unenforceable, the remaining provisions remain in effect.
- Choice of Law and Venue: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms and Conditions or the services provided shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.
