IMPACT ENVIRONMENTAL COMPANY, INC. GENERAL TERMS AND CONDITIONS

APPOINTMENT PREPARATION:

Appliances: All appliances must be emptied including refrigerators and freezers prior to removal. Also, all water and gas lines must be disconnected prior to our arrival as our employees are not allowed to disconnect these items for both your safety and ours.

Specialty Items: Removing and hauling away unique items can result in specialty fees or the need for additional manpower. Keep in mind, there may be items we are unable to remove or there may not be an option for proper disposal.

Cleanliness: Impact Environmental Company has the right to refuse to remove unsanitary items or work in unsanitary/unsafe conditions.

Parking: Ample parking must be available for our truck(s). Parking areas and walkways should be clear of any obstructions. Should the customer be concerned about the weight of the truck or load causing damage to their private driveway, please advise us in advance as Impact Environmental Company is unable to accept liability after the fact.

Safety: Licensing and liabilities prevent our company from removing flammable liquids, paint or industrial chemicals, firearms, explosives, any container filled with gasoline or propane, medical waste, or other hazardous items.

DAY OF ARRIVAL:

Arrival Time: Time of arrival is approximate. Times will be scheduled in two-hour time blocks, either in the morning or afternoon. We will contact you if the arrival time changes significantly from what was originally planned.

Children and Pets: Keep children and pets occupied during the removal of your items. We want to make sure everyone (and every animal) stays safe during the appointment.

Weather: Removal of your items will proceed during poor weather unless weather conditions create safety concerns.

Liability: Your agreement to the appointment waives any liability or responsibility by Impact Environmental Company for any existing damages to the site prior to our arrival. We reserve the right to decline additional services requested should those services pose risk of liability.

Inspection: We will document any work needed on site prior to the start of the job, and we will make sure items have been removed from requested areas and have been loaded on our truck(s) properly.

Customer Representation: We ask that you be present during the entire appointment. Should you have to leave the premises for any reason, we ask that an adult representative be available. For curbside pick-ups attendance is not required, but it is advised. Customers are prohibited from assisting our company in the process of the removal and waive any legal obligation for injuries obtained during the removal that are not a direct result from Impact Environmental Company.

PAYMENT:

Payment Method: Payment is due at the completion of the removal. Accepted forms of payment include cash, check, major credit cards (Visa, MasterCard, Discover Card and American Express), or Venmo.

Estimates: Any estimates given are based on information provided by the customer. Estimates are given to inform you of approximate costs and allow us to schedule our appointments appropriately. Actual charges reflect the total volume filled by your requested items to be removed, plus any specialty fees (including but not limited to additional disposal costs or workers required for the job). Menu pricing will be made available upon request for any costs related to the individual removal of items.

Scheduling and Deposit: To schedule an appointment, we may require a valid credit card number or other secured funds as a deposit. You will be charged the deposit at the time of scheduling. We will apply remaining charges to your credit card when services are completed, if that card is your preferred method of payment.

Tips: (We only mention this because so many people ask.) Yes, our team members can accept tips, but, of course, only if you desire to tip and feel they deserve it.

Cancellations: We request an advance cancellation notice for any removal service. If our team members arrive and if for any reason you cannot remove your items at the scheduled time, a penalty may apply. Cancellation policies may vary.

Damages: Items requested for removal are not covered for damages. If there is damage to the premises, it is the responsibility of the customer to notify Impact team members immediately. They will complete a report before they leave your site. If you discover damage after the removal has been completed, call Impact Environmental immediately, at 619-393-6265. No damage claims will be honored until the charges for your removal services have been paid in full.

APPLICATION USE / TECHNOLOGY TERMS OF SERVICE

Use of the Impact Environmental Company Website, Online Platform or Mobile App for both Apple or Android devices means you agree to the following:

User Terms and Privacy: Impact Environmental Company will not sell or share any of your personal data at any time. Any information given to Impact Environmental Company, either on the App, digitally on any platform, or online, becomes the sole property of Impact Environmental Company (including photos you share with us). We ensure that any personal data input into our system is protected and will not be sold, shared or distributed to any outside entity.

Intellectual Property Rights: Impact Environmental Company are the owners and the licensers of all intellectual property rights for our platform, and with the material published on it. These works are protected by copyright laws and treaties around the world. All such rights are reserved. In accessing our platform you agree its contents and services are solely for your personal, non-commercial use. Our platform, including any part of it, may not be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of Impact Environmental Company. This excludes the downloading, copying, and/or printing of content from our platform for personal, non-commercial home use only.

Prohibited Conduct: You agree to use the App and our platform in accordance with our terms and other applicable laws and regulations. You will not violate any applicable law, contract, intellectual property or other third-party right or commit a tort, and you are solely responsible for your conduct while accessing or using the App or our platform. In connection with your use of the App (and our services) you will not engage in any harassing, threatening, intimidating, predatory, or stalking conduct. You will not impersonate another person or authorize an account for which you do not have access. You will not reverse engineer, decompile, or disassemble any aspect of the App, or do anything that might discover source code or bypass or circumvent measures employed to prevent or limit access to any parts of the App; or develop or use any third-party applications that interact with the App or our services without prior written consent.

Termination: If you are in breach of any of these terms, we reserve the right, in our sole discretion, to terminate your right to access or use the App or our services. Impact Environmental Company is not responsible for any loss, damage, or harm related to your inability to access or use the App or our services based on such termination.

RIGHT TO UPDATE OR MODIFY TERMS:

Impact Environmental Company reserves the right, at our discretion, to change our terms on an ongoing basis at any time. It is your responsibility to check our terms periodically for any changes. Your continued use of our services, App, or platform after any changes become effective, constitutes your binding acceptance of such changes. In the event that a change to the terms materially modifies your rights or obligations to our services, we will make an effort to notify you of the change. Immaterial modifications are effective upon publication, and material changes will be effective upon the earlier of (a) continued use of our services with actual knowledge of the modification, or (b) thirty days following the change.

WARRANTY AND DISCLAIMER:

Impact Environmental Company endeavors to provide the best service possible, but it is the responsibility of the customer to understand and agree that our services are provided "as is" and "as available", without express or implied warranty of any kind. Impact Environmental Company is bonded and insured, and will take every reasonable measure to provide the best and safest service possible, but use of any Impact Environmental Company service or platform is done at the customer's own risk. As with any purchase of a product or service through any medium or in any environment, a customer should use their best judgement and exercise caution where appropriate. No advice or information, whether oral or in writing obtained by anyone from Impact Environmental Company shall create any warranty on behalf of Impact Environmental Company in this regard. This does not affect any statutory rights for a valued customer.
