Eco Valley Chem-Dry Terms & Conditions

1. Authorization and Payment
By signing or approving a service electronically, the customer agrees and acknowledges full understanding of these terms, including all disclaimers, risks, and limitations of liability. Authorization to perform work constitutes acceptance of these conditions. The signatory affirms that they are the property owner or authorized agent with authority to consent to work being performed on the property.

All charges are due upon completion unless otherwise agreed in writing. If payment is not made when due, interest may accrue at 5% per month or allowed interest of the state in which the work was performed. The customer agrees to pay all reasonable attorney, collection, and court costs incurred to collect unpaid balances. Non-payment voids any associated guarantees and warranties.

2. Guarantee of Workmanship
Chem-Dry guarantees its cleaning workmanship and will readdress any issues within a reasonable time if contacted promptly. This guarantee does not extend to pre-existing conditions or effects outside Chem-Dry’s control.

3. Safety Advisory
During and after cleaning, carpets, tiles, and hard surfaces may be slippery until fully dry. Customers and pets should avoid all areas being cleaned and use caution to prevent accidents and assume liability for their own actions. The customer understands that birds and sensitive pets should be removed from the area due to potential sensitivity to cleaning products.

4. Liability and General Disclaimer
Chem-Dry guarantees professional workmanship consistent with industry standards. However, due to the nature of cleaning and restoration, complete removal of stains, odors, or discoloration cannot be guaranteed. Variations in carpet and fabric construction, age, dyes, and pre-existing conditions can influence results.
Chem-Dry is not responsible for:
Pre-existing damage, discoloration, defects, excess residue or wear
Manufacturer or installer inconsistencies or colorfastness failures
Shrinkage, fading, or texture changes resulting from cleaning
Damage from hidden conditions (e.g., urine deposits, delamination, weak seams)
Issues due to non-colorfast dyes, excessive wear, or improper prior cleaning
Chem-Dry’s liability is limited to the price of the service or treatment performed. The company is not responsible for indirect, consequential, or incidental damages.

Chem-Dry aims for complete customer satisfaction. If a dispute arises, the customer agrees to first provide Chem-Dry an opportunity to inspect and address the concern. Each Chem-Dry location is independently owned and operated. All services, warranties, and liabilities are the responsibility of the individual franchise location performing the service.

5. Specific Service Agreements and Waivers

A. Carpet Cleaning:
The customer acknowledges that carpet may remain damp for several hours following service and that transition areas between damp and hard surfaces may be slippery. Caution is advised to prevent slips or falls. Chem-Dry is not responsible for conditions such as loose carpet, split seams, permanent stains, bleach marks, or residue from previous treatments.

B. Pet Damage and Pet Urine Removal Treatment (P.U.R.T.®) & Rug Urine Treatment (R.U.T.):
Pet urine is a complex mixture that can permanently damage fibers, backing, and flooring. Chem-Dry does not guarantee complete odor or stain removal. Treatment may result in color change, yellowing, wicking, or shrinkage. Customer acknowledges these risks before service.

C. Stain Removal Treatments - Stain Out™, Red Alert®, etc.):
The customer understands that while these treatments can be effective, results vary due to differences in carpet fibers, dyes, and prior chemical exposure. Discoloration, bleaching, or incomplete stain removal may occur. The customer holds Chem-Dry harmless for any damage resulting from the stain removal process.

D. Upholstery, Drapery, and Area Rugs:
Upholstery and textiles can contain materials that react unpredictably to cleaning due to age, dye instability, dry rot, or previous cleaning damage. Chem-Dry will not be liable for fading, shrinkage, or structural weakening caused by inherent material issues or pre-existing conditions.

E. Tile, Stone, Wood, Luxury Vinyl & VCT Floors:
Chem-Dry’s different hard floor cleaning and restoration processes are designed to remove built-up residue and improve floor appearance; however, we cannot guarantee uniform gloss or appearance. While Chem-Dry takes care during service, pre-existing structural weaknesses may worsen. Some hard floors and surfaces may contain pre-existing cracks, damaged grout, or loose tiles. Due to variations in finish type, age, pre-existing damage, and exposure to moisture. If a coating or finish is present, stripping and refinishing floors may be required and comes at an additional cost. Slight dulling, haze, or color variance may occur, especially in areas of heavy wear or prior coating buildup. The customer acknowledges these risks and understands that refinishing or replacement may be required for severely worn floors.

F. Protectants and Sealers:
Protectants and sealers are applied according to manufacturer specifications but cannot guarantee future stains due to normal wear, cleaning, and environmental factors.

6. Privacy Policy
Chem-Dry collects customer information such as name, address, phone number, and payment details to process orders and deliver services. Chem-Dry may retain customer contact information for future service reminders, warranty follow-ups, or promotional offers. This information is kept confidential and is only shared with trusted partners directly involved in service fulfillment. Chem-Dry complies with all applicable privacy laws, including the California Consumer Privacy Act.

Customers may unsubscribe from promotional communications at any time. All sensitive payment information is processed securely and encrypted per industry standards.

7. Photos and Media Authorization
Customer grants permission for Chem-Dry to take photos or videos of completed work for marketing purposes. Identifying information (like addresses or faces) will not be used. Customers must initial a consent section to authorize media use.

8. Customer Responsibilities
Any occupants, children and/or pets are in the care and custody of the customer and as such they are fully responsible for any loss or damage caused by them. Customers are responsible for their property whether they own or rent for securing their property, fragile items, breakables, and valuables before service. Chem-Dry technicians are not responsible for moving heavy or delicate furniture unless expressly agreed upon and may come with additional charges. Customers must also ensure access to water, power, and adequate parking for service vehicles.

9. Cancellations/Rescheduling and Unforeseen Circumstances
Customers must provide at least 24 hours’ notice to cancel or reschedule an appointment. Missed appointments or cancellations made with less than 24 hours’ notice may be subject to a service charge or deposit forfeiture at Chem-Dry’s discretion.
Chem-Dry shall not be liable for delays or failure to perform due to circumstances beyond its reasonable control, including but not limited to weather, labor disputes, accidents, equipment failure, or supply shortages.
