Contract is to furnish Labor and Material to complete jobs in accordance with above specifications. Payment is to be made as follows: 50% down upon signed contract. Balance upon completion. All work is to be completed in a workmanlike manner according to standard practices. Any alteration or deviation from above specifications involving extra costs will be executed only upon written orders and will become an extra charge over and above the agreed upon total. All agreements are contingent upon strikes, accidents or delays beyond the company’s control. Delays in work schedule may cause additional charges for Mobilization .
All items below will apply unless initialed by Company Officer:
________ 1.) Permit fees and bonds or any other applicable fees are not included in this agreement.
________ 2.) Prices do not include Engineered drawings or plans, as may be required by the building department.
________ 3.) Owner responsible for any conflicts with construction due to elevation and locations of existing utilities.
________ 4.) Contractor guarantees workmanship for a period of one (1) year.
In the event of litigation to enforce the terms of this contract, the prevailing party shall be entitled to reasonable attorney, fees and costs including an appeal.
An unpaid balance over thirty (30) days of completion will accumulate a late fee at 18.0% annual percentage rate.
